Si bien la fiscalidad es polémica per se, hay tributos que son más discutibles que otros. No hay que olvidar que la doble imposición está prohibida por la legislación española y comunitaria. La mayoría de los Estados europeos son conscientes de esta contradicción, de ahí que el impuesto no esté generalizado. El resultado es que son muy pocos los miembros de la Unión Europea que lo contemplan. Tan solo España, Francia, Países Bajos e Italia lo contemplan. Estamos hablando de 4 sobre 28, y conviene decir que los planteamientos de país a país varían. Si bien se grava la riqueza, hay cambios en cuanto a la tasa a abonar.
Si esto no fuese poco importante, hemos de decir que varios Estados lo han suprimido: Finlandia, Austria, Alemania, Irlanda, Luxemburgo, Suecia y Grecia, entre otros. En muchos casos, porque se entiende que los impuestos directos sobre la renta ya cumplen con esa función. Finalmente, indicar que en España su aplicación ha sido intermitente, en función de la coyuntura económica.
En consecuencia, podemos afirmar que la aplicación de este tributo no es, en absoluto, generalizada. Además, allí donde se cobra, las cantidades que hay que recibir son variables.
