El IVA en la Asistencia Jurídica gratuita. ¿Es de aplicación?
En junio de 2017 entró en vigor la Ley 2/2017, de 21 de junio, que modifica la Ley 1/1996, de 10 de enero, de asistencia jurídica gratuita y con la que se intenta garantizar la plena efectividad del turno de oficio de la abogacía.
En la ley se establece que los profesionales están obligados a prestar este tipo de asistencia jurídica en el marco de la Ley 1/1996, y por ende, se entiende el carácter indemnizatorio de las cantidades percibidas por éstos.
La ley, en su redacción, no hace referencia al régimen tributario de las prestaciones de servicio obligatorias y si deben o no estar sometidas al impuesto del valor añadido (IVA). Sin embargo, de su texto quedan claros los conceptos siguientes:
Obligatoriedad de la prestación del servicio de asistencia jurídica gratuita.
El turno de oficio y asistencia jurídica gratuita es obligaría para los profesionales que ejerzan la abogacía según la Ley 1/1996. Son los colegios profesionales los que organizan y dispensan, si es el caso, al profesional.
Derecho a compensación del profesional.
Los profesionales que ejerzan asistencia jurídica gratuita tendrán derecho a una compensación económica que tendrá carácter indemnizatorio. Y por tanto, no será de aplicación el IVA en la asistencia jurídica gratuita.
Pese a que entró en vigor en junio de 2017, la Ley 2/2017 establece que será de aplicación y producirá efectos desde el 1 de enero de 2017. Esta retroactividad ha generado cierta confusión consultas vinculantes en las que la DGT establecía que los servicios prestados por abogados y procuradores en ejercicio de la asistencia jurídica gratuita estaban sujetos a IVA y no exentos. En este hilo, también la STJUE de 28 de julio de 2016 fijaba tal sujeción.
¿Cómo queda el IVA en la Asistencia Jurídica Gratuita?
A pesar de la confusión que puedan causar la contradicción entre las consultas vinculantes y la aplicación de la nueva L2/2017, queda claro que desde enero de 2017, el turno de oficio tiene carácter obligatorio y no está sujeto a IVA. Además, las remuneraciones que puedan obtener los profesionales que lo ejerzan, tendrán carácter indemnizatorio. Lo que no está claro y deberían aclarar la DGT o la AEAT es si las operaciones realizadas por los profesionales durante los últimos meses de 2016 están o no exentas.
Así mismo, debería aclararse si el hecho de excluir la asistencia jurídica gratuita de la aplicación de IVA, podría dar lugar a la no deducibilidad del IVA en la parte proporcional que corresponda (prorrateo). En este sentido, el TJUE ha señalado que, para que el IVA sea deducible, las operaciones por las que se soporta el IVA deben estar directa e inmediatamente relacionadas con las operaciones por las que se repercute el IVA.
De no aclararse, queda bajo cierta situación de inseguridad la aplicación o no del IVA en la asistencia jurídica gratuita. Y en su caso, el prorrateo del IVA soportado.
